These Terms of Use govern your access to and use of CarebidetUSA.com, including its publicly available information, videos, downloadable materials, contact and consultation features, and password-protected training content.
CarebidetUSA.com is owned and operated by Connected Health Solutions, LLC, doing business as COHealth ("COHealth," "we," "us," or "our"). COHealth is the exclusive United States master distributor and reseller of Carebidet, manufactured by Curaco, Inc. Curaco also holds a minority ownership interest in COHealth.
By accessing or using the Website, or by creating or using a training account, you agree to these Terms. If you do not agree, you should not use the Website or its password-protected content.
The Website does not currently process online purchases or offer paid subscriptions. If products or paid services are offered through the Website in the future, additional terms may be presented at the time of purchase or enrollment.
Information provided through the Website is for general educational purposes. It does not replace medical advice, diagnosis, treatment, Carebidet product instructions, or the judgment of qualified healthcare professionals and caregivers. Carebidet may not be appropriate for every person or care setting.
SECTION 1 ELIGIBILITY AND WEBSITE USE
The Website is intended for adults seeking information about Carebidet, toileting care, caregiver support, training, or related services. The Website may be used by individuals, family caregivers, healthcare professionals, care organizations, and other authorized visitors.
You must be at least 18 years old and legally capable of entering into an agreement to create a training account, submit a consultation request, or otherwise provide information through the Website. If you use the Website on behalf of an organization, you represent that you have authority to act on its behalf.
The Website is not directed to children under 13, and children under 13 should not submit personal information through the Website.
SECTION 2 INTELLECTUAL PROPERTY AND ACCEPTABLE USE
The Website and its contents, including text, graphics, photographs, videos, training materials, assessments, downloads, page designs, logos, and other materials, are owned by or licensed to COHealth, Curaco, Inc., or their respective content providers and are protected by applicable intellectual property laws.
Carebidet and related product names, trademarks, designs, images, and materials may be owned by Curaco, Inc. or used by COHealth under authorization. Nothing in these Terms transfers ownership of any intellectual property to you.
Subject to these Terms, COHealth grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website and its materials for personal, educational, caregiving, or internal professional purposes. This permission does not include the right to reproduce, distribute, sell, license, publicly display, modify, create derivative works from, or commercially exploit Website content without prior written permission from the applicable rights holder.
You may not:
1. Copy, download, record, reproduce, distribute, or share password-protected training materials except as expressly authorized by COHealth;
2. Share training credentials or allow another person to complete training or assessments through your account;
3. Remove copyright, trademark, attribution, or other proprietary notices;
4. Use the Website or its content in a misleading, unlawful, fraudulent, or harmful manner;
5. Attempt to gain unauthorized access to the Website, training platform, user accounts, servers, or connected systems;
6. Introduce malicious code, interfere with Website operation, or circumvent security or access controls;
7. Use automated systems to scrape, extract, copy, or collect Website content or data without written permission; or
8. Use Carebidet, COHealth, Curaco, or related names, logos, materials, or product information in a way that falsely suggests sponsorship, authorization, or affiliation.
Publicly available Carebidet materials may be downloaded or shared only where the Website expressly provides that option and only for their intended, noncommercial purpose.
SECTION 3 PRIVACY AND INFORMATION YOU PROVIDE
COHealth's collection, use, storage, and disclosure of personal information through CarebidetUSA.com are described in the CarebidetUSA Privacy Policy, which is incorporated into these Terms by reference.
The Website may collect information when you contact COHealth; complete a Carebidet questionnaire; schedule a consultation; register for or participate in training; request support or information; or otherwise communicate with COHealth.
You agree to provide information that is accurate to the best of your knowledge. If you submit information concerning another person, you represent that you are authorized to provide the information for the applicable inquiry or caregiving purpose.
Care-related information should be limited to what is reasonably necessary for the inquiry. Do not submit Social Security numbers, financial account information, complete medical records, account passwords, or other information that the Website does not specifically request.
Website forms and ordinary email are not intended for emergencies, urgent medical communications, or transmission of detailed medical records and are not represented as a substitute for a healthcare provider's secure patient portal.
COHealth does not sell personal information. Additional information about Website hosting, forms, scheduling, videos, communications, analytics, technology providers, Curaco, and linked third-party websites is provided in the Privacy Policy.
SECTION 4 TRAINING ACCOUNTS AND PASSWORDS
You do not need an account to access the public portions of the Website. Certain training materials, videos, assessments, and related resources may require registration and password-protected access.
When creating or using a training account, you agree to:
1. Provide accurate and current registration information;
2. Keep your username and password confidential;
3. Use only the account assigned to you;
4. Not share your account or allow another person to access training materials or complete assessments through your account; and
5. Notify COHealth promptly at info@cohealth.solutions if you believe your account has been accessed without authorization.
You are responsible for activity conducted through your account to the extent permitted by law. COHealth may suspend or terminate access when it reasonably believes that an account has been shared, misused, compromised, or used in violation of these Terms.
Any certificate issued through the training program confirms only that the identified participant completed the stated course requirements and assessments as of the date issued. Unless expressly stated otherwise, a certificate does not constitute a professional license, clinical credential, continuing-education credit, guarantee of competency, or authorization to provide healthcare services.
COHealth may withhold, correct, suspend, or revoke a training certificate if it reasonably determines that the course or assessment requirements were not properly completed, that account credentials were shared, or that the certificate was obtained through inaccurate information or misconduct.
SECTION 5 WEBSITE INQUIRIES CONSULTATIONS AND FUTURE OFFERINGS
The Website allows visitors to request information, complete an informational Carebidet questionnaire, contact COHealth, and schedule a consultation. Submitting a form, completing a questionnaire, or scheduling a consultation does not constitute a purchase, create a healthcare provider-patient relationship, guarantee that Carebidet is appropriate for a particular person, or obligate COHealth to provide or sell any product or service.
Consultations and responses from COHealth are intended to provide general product and access information. They do not replace medical advice, a clinical evaluation, professional caregiver judgment, or review of the applicable product instructions.
The Website does not currently process online purchases or offer paid subscriptions. Any product purchase, evaluation program, financing arrangement, or other transaction arranged outside the Website will be governed by the separate written terms provided for that transaction.
If COHealth offers products or paid services directly through the Website in the future, applicable prices, payment terms, shipping terms, return policies, and any additional conditions will be disclosed at the time of purchase or enrollment. COHealth may require acceptance of additional terms before completing such a transaction.
Information regarding product availability, financing, insurance, government benefits, grants, or reimbursement is general information only. Availability and eligibility may vary by individual, provider, program, payer, and location and are not guaranteed by COHealth.
SECTION 6 MEDICAL PRODUCT AND RESEARCH INFORMATION
COHealth is a Carebidet distributor and reseller and is not a healthcare provider. Information on the Website, including condition-specific content, videos, research summaries, calculators, training materials, and responses to general inquiries, is provided for educational and informational purposes only.
Website content is not medical advice and does not replace diagnosis, treatment, clinical evaluation, the instructions for use supplied with Carebidet, or the judgment of qualified healthcare professionals and caregivers. Use of the Website, submission of information, or participation in a consultation does not create a healthcare provider-patient relationship with COHealth.
Carebidet may not be appropriate for every person or care setting. Decisions regarding product suitability, positioning, installation, operation, care protocols, and continued use should be based on the current product instructions and, when appropriate, consultation with the person's healthcare or caregiving team.
Research findings, statistics, case examples, and summaries presented on the Website are provided for general informational purposes. Individual experiences and outcomes vary. References to published studies do not guarantee that the same results will occur for every individual, caregiver, facility, or care setting. Visitors should review the cited source material when making clinical, operational, or purchasing decisions.
Calculators, estimates, and information concerning potential caregiver time, costs, financing, reimbursement, insurance, grants, or other assistance programs are illustrative only. They are not guarantees of savings, coverage, reimbursement, eligibility, or financial results.
The Website is not intended for medical emergencies or time-sensitive clinical communications. If you believe someone is experiencing a medical emergency, contact 911 or the appropriate emergency service.
SECTION 7 TESTIMONIALS AND USER SUBMITTED CONTENT
Testimonials, personal experiences, and case examples appearing on the Website reflect the experiences of the individuals or organizations involved. Individual circumstances and results vary, and no testimonial or case example guarantees that another person, caregiver, or organization will experience the same outcome.
Information submitted through a contact form, questionnaire, consultation request, support request, or training account will not be treated as a testimonial or used publicly merely because it was submitted to COHealth. COHealth will obtain separate permission when appropriate before publicly using a person's name, identifiable story, photograph, video, or other personal content for promotional purposes.
If you intentionally submit a testimonial, review, photograph, video, or other material for publication, you represent that:
1. The information is truthful and based on your actual experience;
2. You own the material or have permission to provide it;
3. You have obtained appropriate permission from every identifiable person appearing in or discussed in the material; and
4. Its use by COHealth will not violate another person's privacy, confidentiality, intellectual property, or other legal rights.
When material is knowingly submitted for publication, you grant COHealth a non-exclusive, royalty-free license to reproduce, display, publish, and reasonably format that material for Website, educational, and promotional purposes, subject to any separate written release or agreement. COHealth may edit submissions for length, spelling, grammar, or clarity but will not intentionally change their material meaning.
COHealth is not required to publish any submission and may remove submitted content at its discretion. Any separate testimonial, photograph, video, patient authorization, or media release will control if its terms differ from this section.
SECTION 8 DISCLAIMER OF WEBSITE WARRANTIES
To the fullest extent permitted by applicable law, the Website and its content are provided on an "as is" and "as available" basis. COHealth does not guarantee that the Website, training platform, videos, downloads, or other online features will always be available, uninterrupted, secure, current, complete, or free from errors, viruses, or other harmful components.
COHealth makes reasonable efforts to present accurate and current information but does not warrant that all Website content is complete, error-free, or appropriate for every individual, caregiver, organization, or care setting. Website content may be corrected, updated, replaced, or removed without notice.
To the fullest extent permitted by law, COHealth disclaims implied warranties relating specifically to the Website and its content, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
This Website disclaimer does not replace, expand, or limit any written product warranty, manufacturer warranty, purchase agreement, evaluation agreement, service agreement, or other terms separately provided in connection with a Carebidet product or service. Those separate terms will govern the applicable transaction.
Some jurisdictions do not permit certain warranty exclusions. Accordingly, these exclusions apply only to the extent permitted by applicable law, and nothing in these Terms limits any rights that cannot legally be waived.
SECTION 9 LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, COHealth and its officers, directors, employees, contractors, agents, licensors, and Website service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:
1. Access to, use of, or inability to use the Website or training platform;
2. Reliance on Website content, videos, research summaries, calculators, training materials, or general communications;
3. Unauthorized access to or alteration of information submitted through the Website; or
4. The conduct, content, or availability of a third-party website or service.
To the fullest extent permitted by law, COHealth's total liability for direct damages arising solely from use of the Website or its online content will not exceed the greater of the amount, if any, paid to COHealth specifically for access to the applicable online service during the twelve months preceding the claim or $100.
This limitation applies regardless of whether a claim is based on contract, negligence, tort, statute, or another legal theory and regardless of whether COHealth was advised that damages were possible.
This section does not govern claims arising under a separate Carebidet purchase agreement, product warranty, evaluation agreement, financing agreement, or service agreement. Those claims will be governed by the applicable separate agreement and applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud or willful misconduct.
SECTION 10 DISPUTE RESOLUTION
Before initiating formal legal proceedings concerning the Website or these Terms, you agree to contact COHealth at info@cohealth.solutions and provide a reasonable description of the dispute. You and COHealth agree to make a good-faith effort to resolve the matter informally for at least 30 days after the notice is received.
If the dispute cannot be resolved informally, either party may pursue available legal remedies, subject to the governing-law and venue provisions in these Terms.
This section applies only to disputes arising from the Website, its online content, training access, or these Terms. Disputes arising from a Carebidet purchase, evaluation, financing arrangement, service arrangement, or other separately documented transaction will be governed by the dispute provisions in the applicable agreement.
SECTION 11 INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless COHealth and its officers, directors, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs, including reasonable attorneys' fees, arising directly from:
1. Your intentional, fraudulent, or unlawful misuse of the Website or training platform;
2. Content or materials you submit for publication that violate another person's intellectual property, privacy, confidentiality, or other legal rights;
3. Your unauthorized sharing or commercial use of password-protected training materials; or
4. Your material violation of these Terms.
This obligation does not require you to indemnify COHealth for claims arising from COHealth's own negligence, willful misconduct, violation of law, or breach of these Terms.
COHealth will provide reasonable notice of an indemnified claim and will not agree to a settlement that imposes a direct admission of liability or nonmonetary obligation on you without your consent, which will not be unreasonably withheld.
SECTION 12 COPYRIGHT COMPLAINTS
COHealth respects the intellectual property rights of others. If you believe that content appearing on the Website infringes a copyright you own or are authorized to enforce, please send a written notice containing:
1. Identification of the copyrighted work you believe has been infringed;
2. Identification and location of the allegedly infringing Website content, including the applicable page address when available;
3. Your name, mailing address, telephone number, and email address;
4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
5. A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act for the copyright owner; and
6. Your physical or electronic signature.
Copyright notices may be sent to Connected Health Solutions, LLC, Attention: Copyright Matters, 421 Montgomery Road, Suite 105, Altamonte Springs, Florida 32714, or by email to info@cohealth.solutions. COHealth may investigate a properly submitted complaint and remove or restrict access to disputed content when appropriate.
SECTION 13 THIRD PARTY WEBSITES AND SERVICES
The Website may contain links to, embedded content from, or features provided by third parties. These may include video hosting, appointment scheduling, questionnaires, forms, research publications, healthcare resources, financing providers, grant programs, government agencies, and partner organizations.
Third-party websites and services, including websites operated by business partners, related companies, or minority owners such as Curaco, are operated independently and may have their own terms, privacy policies, accessibility practices, and security procedures. COHealth does not control and is not responsible for the availability, content, accuracy, security, or practices of third-party websites or services.
A link to or reference to a third party does not necessarily constitute an endorsement, guarantee, or recommendation by COHealth unless the Website expressly identifies the relationship. COHealth is not responsible for transactions, communications, decisions, or disputes between you and a third party.
Information submitted through third-party form, scheduling, video, or similar services may be processed by those providers and made available to COHealth as described in the CarebidetUSA Privacy Policy. You should review the applicable third party's terms and privacy practices before using its services or submitting information.
If you leave CarebidetUSA.com to visit another website, your use of that website is governed by its own terms and policies.
SECTION 14 SUSPENSION AND TERMINATION
You may stop using the Website at any time.
COHealth may suspend or terminate a training account or restrict access to password-protected content if COHealth reasonably believes that:
1. The account has been shared, compromised, or used without authorization;
2. The user has violated these Terms;
3. Suspension is reasonably necessary to protect Website security, other users, COHealth, Curaco, or a third party;
4. Continued access could violate applicable law; or
5. The applicable training program or online service has been discontinued.
COHealth may act without advance notice when immediate action is reasonably necessary for security, legal, or operational reasons. When practical, COHealth may provide notice or an opportunity to correct the issue.
Upon termination of training access, you must stop accessing and using the restricted training materials. Termination does not affect rights or obligations that arose before termination.
Provisions concerning intellectual property, certificates, submitted content, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and other terms that by their nature should continue will survive termination.
Suspension or termination under these Terms does not terminate or modify a separate Carebidet purchase, evaluation, financing, service, or other written agreement unless that agreement expressly provides otherwise.
SECTION 15 GOVERNING LAW AND VENUE
These Terms and disputes arising from or relating to the Website, its online content, training access, or these Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Subject to the informal-resolution process in Section 10, any legal proceeding concerning these Terms or the Website must be brought in the state courts located in Seminole County, Florida, or in the federal courts having jurisdiction over Seminole County, Florida. You and COHealth consent to the personal jurisdiction of those courts.
This section does not prevent either party from seeking appropriate temporary or emergency relief in another jurisdiction when reasonably necessary to protect intellectual property, confidential information, Website security, or legal rights.
This section does not override consumer rights or other protections that cannot lawfully be waived under applicable law.
A separate Carebidet purchase, evaluation, financing, service, or other written agreement may specify different governing-law or dispute provisions. If so, that separate agreement will control the applicable transaction.
SECTION 16 CHANGES TO THE WEBSITE AND THESE TERMS
COHealth may update, modify, suspend, or discontinue Website content, features, videos, downloads, training materials, or other online resources from time to time. COHealth does not guarantee that any particular content or feature will remain available indefinitely.
COHealth may also revise these Terms when its Website, services, legal requirements, or business practices change. The revised Terms will be posted on the Website with an updated "Last Updated" date.
Changes will apply prospectively from their stated effective date. Your continued use of the Website after that date constitutes acceptance of the revised Terms. If a material change affects a registered training user, COHealth may also provide notice through the training platform or by email.
If you do not agree to revised Terms, you should stop using the Website and any password-protected training content.
Changes to these Website Terms do not automatically amend a separate purchase, evaluation, financing, service, warranty, or other written agreement. A separate agreement may be changed only as provided in that agreement.
SECTION 17 GENERAL PROVISIONS
No Waiver. A failure or delay by COHealth in enforcing any provision of these Terms does not waive its right to enforce that or another provision later. A waiver is effective only if made in writing by an authorized COHealth representative.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
Assignment. You may not assign or transfer your rights under these Terms without COHealth's prior written consent. COHealth may assign these Terms in connection with a merger, restructuring, financing, sale of assets, change of control, or transfer of the Website or related business operations.
Events Beyond Reasonable Control. COHealth will not be responsible for delays, interruptions, or failures caused by circumstances beyond its reasonable control, including natural disasters, utility or internet failures, cyberattacks, government actions, labor disruptions, public-health emergencies, or failures of third-party service providers.
Electronic Communications. When you communicate with COHealth electronically, you consent to receiving responses, notices, and records relating to that communication electronically. This provision does not, by itself, constitute consent to receive unrelated marketing communications.
Entire Agreement. These Terms and the CarebidetUSA Privacy Policy constitute the agreement between you and COHealth concerning use of the Website and its online content. They do not replace or modify any separate purchase, evaluation, financing, training-service, warranty, confidentiality, partner, or other written agreement.
Headings. Section headings are provided for convenience and do not affect the interpretation of these Terms.
